Marketing Agreement with Pharmacies, Developed by Legal Alliance, Sustained Examination of the AMC of Ukraine
Legal Alliance Company represented the interests of GlaxoSmithKline Ukraine at the Antimonopoly Committee of Ukraine in relation to conclusions obtainment in the form of advisory clarification regarding Ukrainian Competition Law compliance of the marketing agreements concluded with the pharmacies and pharmacy chains.
Upon the consideration of the provided materials the Antimonopoly Committee has come to the conclusion that given marketing agreement does not contain any signs of the abuse of monopoly and anticompetitive concerted actions conducted by GlaxoSmithKline Ukraine.
Within the framework of the project Legal Alliance associates drafted a marketing agreement with all required amendments that comprehensively reflect the Client’s objectives and consider all competitive risks.
Moreover, the project team put major efforts into the materials preparation aimed at the justification of Competition Law non-infringement by the drafted marketing agreement concluded with the pharmacies and pharmacy chains. In particular, the team made a comprehensive research on medicinal product markets, which may be affected by the concluded marketing agreement, conducted social and marketing studies, analyzed the experience of GlaxoSmithKline group of companies regarding the relevant agreements in other countries, developed internal standard operating procedures for the Client with regard to pharmacies and pharmacy chains cooperation.
